Regular Meeting

W2017- 4 Application for a Timber Harvest at 44 Old River Road (Map 43 Lot 02 Zone R80) Owner: Brian Violette Applicant: Ben Landry (Received March 13, 2017 Public Hearing or decision by April 10, 2017) Site walk APRIL 8, 2017 @ 9:00am

T. Gutowski and P. Lord conducted a site walk on April 8th.  P. Lord said the site conditions were not going to support the original plan and the applicant came up with an alternate plan that will support the terrain.  T. Gutowski said she saw two thirds of the property and did not see any water.  She said the site is very steep.  T. Gutowski asked the timeline and Brian Violette said most likely the middle of summer.  The Commission agreed they would like to be notified prior to the start of the harvest.  
T. Gutowski motioned to approve application W2017-4 based on the April 10th alternate plan with the following notations:
  • Per the submittal, the Forester is to implement erosion control along skid trails as needed and notify the Commission prior to the start of the timber harvest.
P. Lord seconded the motion.  All in favor.  Motion carried.
The applicant questioned why he had to apply for a permit. S. Yorgensen said he is requesting an agricultural exemption. T. Gutowski said, at the time of the application, they did not know if there were vernal pools on site.  Further discussion was held on permittable acts and Mr. Violette provided the commission with an informational brochure.  
New Business:

W2016-29 Application to construct Single Family Dwelling at 190 Ruby Road (Map 38 Lot 29 Zone R80) Owner/Applicant: David Lytwyn (Received December 12, 2016 Public Hearing or decision by February 13, 2017 extension granted P. H. or decision by April 10, 2017) Application withdrawn
W2017-6 Application for Extension of Wetland Permit W2006-57 approved on 12/11/06 & 5/ 9/11 for west side of Lohse Road (Map 46 Lots 1-B & 1-16 Zone R80) Owner/Applicant: D. W. Fish Home Builders, LLC (Received April 10, 2017 Public Hearing or decision by May 22, 2017)

Don Fish and Eric Peterson were present.  Mr. Peterson, of Gardner & Peterson Associates, said in 2006 they came before the board and were asked to go to a shared driveway.  He said there is not a lot of interest in the lots and they are requesting an extension of the Wetland Permit.  

T. Gutowski motioned to grant the extension for 14 years from the original date of the application.  The extension was granted until December 11, 2020.  M. Drobney seconded the motion.  All in favor.  Motion carried.

Staff Report and Discussion

Kathy Demers, of Mason Road, expressed her concerns on allowing fracking waste in town.  She explained the definition of fracking waste and presented the Commission with an informational document.  She said a lot of towns are not allowing storage facilities for fracking waste and banning the waste.  Ms. Demers said she is not sure what the Commission can and cannot do and a discussion was held.  

Ms. Demers said she met with the Board of Selectmen on an ordinance and will be meeting with them again.  The Commission said they can express their concerns on fracking waste.  A discussion was held on transporting the waste.  A discussion was held on the ordinance given to the Board of Selectmen and Ms. Demers said she will provide the Commission with a copy of the draft.  P. Lord said they can only do something if they have an application before them.  T. Gutowski said they will take a look at the regulations and look forward to the town meeting.

A discussion was held on the Town of Willington Inland Wetlands Forest Practice Regulations.  T. Gutowski asked the Commission to take a look at them and asked S. Yorgensen to put it on the agenda for the next meeting.

M. Drobney motioned to approve the minutes of March 13, 2017.  T. Gutowski seconded the motion.  All in favor.  Motion carried.
